Charity Events & Legal Consequences:
There has been some confusion about charity events and we want to make sure our members aware of the rules from the Texas Attorney General for charity poker/casino events. Many events that are put on around the area are actually run illegally, according to the Texas Attorney General guidelines. Any poker event, charity or otherwise, that REQUIRES you to make a donation (buy-in) to play and gives prizes of value, IS ILLEGAL! According to the AG (
complete opinion):
Under Texas law, there are essentially three parts to an activity that could make it illegal gambling:
-
Money or anything of value is paid to enter the game
-
The winners are decided by a game of chance
-
Prizes of value are awarded.
If all three of those conditions are met, then the activity may be considered gambling – and illegal. If the game is free to enter, then prizes of value may be awarded. If an entry fee is charged, then prizes of value may not be awarded.
All charity events that Drop N Aces hosts or participates in are run legally according to these guidelines. We have had several discussions with TABC and local law enforcement to ensure that we are following all the laws so that our players can come, play and feel comfortable that they will not get busted for playing in an illegal game(Class A Misdemeanor).
